Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and the RecordBTC Team ("we," "us," or "our") concerning your access to and use of the RecordBTC website, applications, and all related tools and services (collectively, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.

You also agree to our Privacy Policy, which is incorporated by reference into these Terms and describes how we collect and use your information.

Eligibility

You must be at least 18 years old and of legal age to form a binding contract in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement.

The RecordBTC Service

RecordBTC provides a set of tools for informational and educational purposes related to cryptocurrency assets. Our features include, but are not limited to:

  • Creating, tracking, and managing Dollar-Cost Averaging (DCA) investment plans.
  • Manually logging and noting your transactions.
  • Historical backtesting of investment strategies.
  • Displaying market data and sentiment indicators (such as the Fear & Greed Index).
  • Optional notifications and alerts (via Email or SMS) regarding your plans or market conditions.

THE SERVICE IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. RecordBTC is not a financial advisor, broker, or planner. No content or feature provided by the Service (including backtesting results, DCA plan simulations, or market sentiment) constitutes personalized financial, investment, legal, or tax advice, or a recommendation or solicitation to buy, sell, or hold any security or cryptocurrency. You are solely responsible for your own investment decisions.

NO CUSTODY / NO EXECUTION

RecordBTC IS NOT AN EXCHANGE, BROKER, CUSTODIAN, OR FINANCIAL INSTITUTION. We do not provide financial services.

  • NO CUSTODY: We DO NOT hold, control, or have custody of any of your funds, cryptocurrencies, or private keys. All your assets remain on your external exchanges or in your personal wallets.
  • NO EXECUTION: We DO NOT execute or facilitate any trades, buys, or sells on your behalf. All transactions are recorded manually by you or tracked via read-only connections (if applicable).

Third-Party Data and Content

Market data, prices, charts, and sentiment indicators (like the Fear & Greed Index) displayed on the Service are obtained from third-party sources. We do not create, control, or guarantee this information. This data may be delayed, inaccurate, or incomplete. You must not rely on this data for making financial decisions and should always verify it with independent sources.

Account Registration and Security

You may need to create an account to use the Service. You agree to:

  • Provide accurate and complete information.
  • Keep your account credentials (like your password) confidential.
  • Be fully responsible for all activities that occur under your account.
  • Notify us immediately at [email protected] of any unauthorized use.

We may log IP address and time information for security purposes, but will not share this with third parties. If you opt-in to Email or SMS alerts, please be aware that standard messaging rates from your mobile carrier may apply.

Acceptable Use Policy (AUP)

You agree not to use the Service to:

  • Engage in any fraudulent, deceptive, or illegal activity.
  • Scrape, spider, or otherwise attempt to extract data from the Service (other than through intended API use, if offered).
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Attack, disrupt, or place an unreasonable load on our servers (e.g., Denial of Service attacks).
  • Bypass any security measures we have in place.
  • Use the Service for any commercial purpose without our prior written consent.

We reserve the right to investigate violations and may, at our sole discretion, implement rate-limiting, suspend, freeze, or terminate your account without notice.

Beta Features

We may, from time to time, offer new features in a "beta" or "test" version. These features are provided "AS IS" and without warranty. They may contain bugs, errors, or inaccuracies and may not be stable. Your use of Beta Features is at your own risk. We may collect anonymous usage feedback to improve these Beta Features.

Intellectual Property Rights

  • Our IP: The Service, including its "look and feel," source code, text, graphics, logos, and trademarks, is the exclusive property of the RecordBTC Team and its licensors, protected by copyright and trademark laws.
  • Your Data: You retain all ownership rights to the data you manually input into the Service (e.g., your transaction logs, notes) ("User Content").
  • License from You: To provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely for the purpose of operating and improving the Service for you.
  • Feedback: If you provide us with feedback, ideas, or suggestions, you grant us an unrestricted, perpetual, royalty-free license to use that feedback for any purpose.

Modifications to the Service and Terms

We are constantly improving the Service. We reserve the right to modify, add, or remove features at any time.

We also reserve the right to update these Terms. If we make a material change, we will provide you with reasonable notice (e.g., by email or an in-app notification) before the changes become effective. We will always post the "Last Updated" date at the top. Your continued use of the Service after the "Effective Date" constitutes your acceptance of the new Terms.

Term and Termination

These Terms remain in effect until terminated by you or us.

  • Termination by You: You may terminate this agreement at any time by ceasing to use the Service and deleting your account.
  • Termination by Us: We may suspend or terminate your access to the Service at any time, with or without cause, particularly if you violate these Terms (especially the AUP) or if we are required to do so by law.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (such as IP rights, disclaimers, and liability limitations) will survive.

Warranty Disclaimers and Limitation of Liability

Warranty Disclaimer: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DATA (INCLUDING THIRD-PARTY DATA) WILL BE ACCURATE OR RELIABLE.

Volatility Risk: YOU ACKNOWLEDGE THAT CRYPTOCURRENCY ASSETS ARE HIGHLY VOLATILE AND SPECULATIVE. PAST PERFORMANCE, INCLUDING BACKTESTING RESULTS, IS NOT INDICATIVE OF FUTURE RESULTS. YOU MAY LOSE YOUR ENTIRE INVESTMENT.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE RECORDBTC TEAM OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES (WHETHER INCURRED DIRECTLY OR INDIRECTLY), OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE (IF ANY). THIS LIMITATION APPLIES REGARDLESS OF THE CAUSE, INCLUDING (A) YOUR USE OF THE SERVICE; (B) YOUR INVESTMENT DECISIONS; OR (C) ANY ERRORS OR INACCURACIES IN THE SERVICE'S CONTENT.
